WHAT CLINICIANS NEED TO KNOW ABOUT LEGAL LIABILITY SATURDAY, NOVEMBER 9, 2019 PRESENTER: JONATHAN D. RUBIN, J.D.

This presentation will provide an overview of the many malpractice litigation risks faced by psychiatrists, psychologists, psychoanalysts/therapists and social workers in New York State. Dr. Rubin will discuss some of the tools and protections available to mental healthcare providers to help reduce the risk of litigation and to mitigate liability.  This workshop will provide an overview of malpractice claims against mental health providers, highlight common risks in the practice, and outline means to protect providers and their practice. Topics will include record keeping, confidentiality and privilege, the duty to protect third parties from a dangerous patient, terminating treatment of a patient, informed consent, and improper relationships with a client.

Learning objectives:

Participants will: 1) understand the different kinds of malpractice litigation risks to mental health providers, 2) learn what some of the most important best practices for avoiding liability are, and 3) learn the tools and protections available to help reduce the risk of litigation.

PRESENTER: JONATHAN D. RUBIN, J.D. Senior Partner: Kaufman, Borgeest & Ryan LLP.  Practice areas include Medical Malpractice Defense, Long Term Care and Nursing Home Defense, Health Care, Products Liability Defense and General Liability Defense Litigation.  He represents hospitals, nursing homes, physicians and health care professionals in civil litigation matters in state and federal courts, and has presented on topics including the litigation of complex medical malpractice matters and risk management issues for health professionals. His expertise is in the defense of mental health providers and he has lectured extensively, including ASHRM lectures focused on “Managing Psychiatric Patients in Acute Care Settings,” lectures for NYS Chapter of the American Psychological Association, NASW and other psychoanalytic and psychotherapy organizations.

The New York State Education Department has approved this workshop for 3 contact hours (CEUs) for LMSWs, LCSWs, LMHCs and LPs. A certificate will be emailed upon request to those who sign the attendance sheet at the end of the workshop and complete an evaluation.

MITPP, chartered by the New York State Board of Regents, offers three certificate programs: a three year program in Psychoanalytic Psychotherapy with Adults, a two year program in Child and Adolescent Psychotherapy, and a program leading to the New York State license in Psychoanalysis. Social Workers may qualify for the LCSW through their training at MITPP. Matriculants see patients at the Metropolitan Center for Mental Health, which is licensed by the Office of Mental Health. Truly affordable training: Low tuition of $1,200 per semester includes both individual and group supervision and up to three courses. Courses are also offered on a non-matriculated basis.
